Content Responsibility & Disclaimer

Last updated: September 2026

Conttessa is a hospitality content management and distribution platform provided by h2c GmbH (“h2c”). It enables hotels and hotel companies to centrally maintain structured hotel information and, depending on the services agreed, to distribute or make such information available to distribution channels, third-party platforms and other authorised applications.
This Content Responsibility & Disclaimer explains the respective responsibilities of the customer, h2c and third-party platforms in relation to content managed through Conttessa.

1. Responsibility for Hotel Information

The hotel or hotel company using Conttessa (“Customer”) is responsible for the factual accuracy, completeness, timeliness and legal compliance of the hotel information it provides, enters, confirms, approves or otherwise makes available for use through Conttessa.
This includes, for example, information relating to the property, facilities, services, room types, amenities, policies, food and beverage offerings, accessibility, sustainability information, guest services and other property-related information.
The Customer is responsible for ensuring that the hotel and property information maintained in Conttessa is factually accurate, complete and up to date and reflects the actual characteristics, facilities, services and policies of the respective property. The Customer is responsible for entering relevant changes in Conttessa in accordance with the agreed content management process.
Unless expressly agreed otherwise, h2c does not independently verify whether factual information supplied or approved by the Customer accurately reflects the actual facilities, characteristics, services or circumstances of the property.

2. h2c's Content Management and Distribution Services

Where content management and/or distribution services form part of the agreed Conttessa services, h2c uses the information provided by the Customer and maintained in Conttessa to manage and distribute hotel content within the scope of the respective contracted channels.
As part of these services, h2c maps and enters the Customer's information into the appropriate available fields, criteria and content structures of the respective distribution channels and performs the agreed content management and distribution activities with due professional care.
Accordingly, the Customer remains responsible for the underlying factual hotel information, while h2c remains responsible for the proper performance of the content management and distribution services agreed with the Customer.
h2c is not responsible for inaccuracies or omissions resulting from incorrect, incomplete or outdated information supplied or approved by the Customer, provided that h2c has processed that information correctly within the scope of the agreed services.

3. Distribution Channels and Other Third-Party Platforms

Online travel agencies, distribution channels and other third-party platforms determine and control their own content structures, criteria, technical requirements and presentation of hotel information. These structures and requirements may be changed by the respective third party.
h2c cannot guarantee that information correctly entered, mapped or transmitted will always be displayed by a third-party platform exactly as maintained in Conttessa or as intended by the Customer.
h2c can only maintain or distribute information to the extent that the respective third-party platform provides corresponding fields, criteria or other means of maintaining such information.

Certain third-party platforms generate or modify hotel descriptions and other displayed content based on structured data, selected criteria, information from other sources or their own systems and processes. In such cases, h2c's ability to influence the wording, content or presentation displayed to the end user may be limited.

h2c is not responsible for modifications, omissions, technical errors, categorisation, processing or presentation occurring within an independent third-party system and outside h2c's reasonable control.

If h2c becomes aware of a discrepancy affecting content managed as part of the agreed Conttessa services, h2c will review the issue and, where it falls within the agreed scope of services and can reasonably be corrected or influenced by h2c, take appropriate steps to address it. Where correction requires action by the respective third-party platform, h2c may contact or follow up with the third party where this forms part of the agreed services, but cannot guarantee that the third party will implement the requested change.

To ensure content consistency and enable h2c to manage the contracted channels reliably, the Customer should use Conttessa as the primary source for changes to content covered by the agreed Conttessa services once the respective property and channel are live in Conttessa.
The Customer should not make parallel changes to such content directly in the extranets of the contracted channels unless agreed with h2c or required in an urgent situation. If the Customer or another authorised third party makes changes directly in a channel extranet, the Customer is responsible for ensuring that the corresponding information in Conttessa is updated accordingly.
h2c cannot be held responsible for discrepancies resulting from changes made directly in third-party systems by the Customer, its employees, representatives or other persons with access to the respective accounts.

4. AI and Other Third-Party Applications

Where agreed and technically available, structured content maintained in Conttessa may also be provided or made accessible to authorised third-party applications, including AI-powered applications, chatbots, virtual assistants, guest communication solutions and other technology systems.
Conttessa may provide the underlying structured hotel information or technical access to that information. Independent third-party applications may subsequently process, combine, interpret or transform this information or use it to generate their own responses or outputs.
Unless expressly agreed otherwise, h2c does not control such third-party processing or generated outputs and cannot guarantee that an independent third-party application will reproduce, interpret or use Conttessa content accurately or completely.
This does not affect h2c's responsibility for correctly providing the Conttessa content in accordance with the agreed service and technical method of delivery.

5. Rights and Permissions

The Customer is responsible for ensuring that it has the rights, permissions and authorisations required to provide content to h2c for processing through Conttessa and, where applicable, for distribution or provision to authorised third-party systems.
The Customer should not provide content for processing through Conttessa where such use would infringe third-party intellectual property rights, privacy rights or other applicable rights.

6. Legal and Regulatory Requirements

The Customer is responsible for ensuring that factual statements and representations concerning its properties comply with legal and regulatory requirements applicable to the Customer and the respective property.
Conttessa reproduces and/or maps content criteria and structures used by distribution channels in order to facilitate hotel content management. The availability of a field, criterion, option or classification within Conttessa does not in itself mean that a particular statement or selection is factually applicable to a property or legally permissible in every jurisdiction.
Conttessa is a content management and distribution service and does not provide legal advice or replace the Customer's own assessment of legal or regulatory requirements applicable to its business.

7. Liability and Contractual Terms

The allocation of responsibilities described above is intended to clarify the respective roles of the Customer, h2c and independent third-party platforms and applications.
Nothing in this Content Responsibility & Disclaimer excludes or limits liability where such exclusion or limitation would not be permitted under applicable law.
In particular, this Disclaimer does not exclude h2c's responsibility for the proper performance of the services expressly agreed with the Customer.
The applicable agreement between h2c and the Customer, including any agreed provisions regarding services, warranties and liability, remains authoritative. In the event of any conflict between this Content Responsibility & Disclaimer and an applicable contractual agreement, the contractual agreement shall prevail.

8. Reporting Content Issues

Customers should notify h2c without undue delay if they identify incorrect, outdated or improperly displayed information in Conttessa or on a distribution channel managed by h2c through Conttessa.
h2c will review reported issues and, where they fall within the agreed scope of services, take appropriate steps to correct or update the information.
